Child Custody

In Texas, the courts favor granting both parents joint custody, absent of parental misconduct, domestic violence or abuse. The issue of custody may arise during the course of a divorce or during those times when the parents are separated. Custody outlines each parent's duties and obligations as it pertains to their child. In Texas, the court may grant one parent sole custody of a child known as sole managing conservator or both parents joint custody known as joint managing conservatorship. 



Child Custody Terms to Know

Child Custody

The care, control, and maintenance of a child, which a court may award to one of the parents following a Divorce or separation proceeding.

Sole Managing conservatorship

an arrangement whereby only one parent has full custody of their child, often awarded in cases where the other parent is abusive or absent.

Physical Custody

a parent has the right to have a child live with him or her.

Conservatorship

a person, official, or institution designated to take over and protect the interests of a child.

Joint Conservatorship

parents share responsibility for major decision making on behalf of the child in matters such as education, religion, and medical crises.

Legal Custody

having the right and the obligation to make decisions about a child's upbringing.
